If Dr. Reich will testify the DNA on the RAV 4 key could come from a toothbrush, why did he not test the key for saliva like he did the hood latch?
I'm no doctor or lawyer, but I did stay in a Holiday Inn Express last night...
| SA | Says he noticed his toothbrush was taken |
|---|---|
| Exhibit #4 Affidavit of Steven Avery - page 2 | I noticed my toothbrush was missing in photographs taken by investigators [...] |
| Dr. Reich | Says DNA on key could be from toothbrush (M05-2467 #C, the Toyota key) |
|---|---|
| Exhibit 15 Affidavit of Dr. Reich - page 12 | [...] some possible examples might include a toothbrush or a cigarette butt. |
| KZ | Says Dr. Reich will testify the DNA on the key came from a rich source like a toothbrush |
|---|---|
| Post Conviction Relief - page 28 | Dr. Reich has offered the opinion that, to a reasonable degree of scientific certainty, [...], such as Mr. Avery's toothbrush. |
However,
| Dr. Reich | Did NOT test for the presence of saliva on the key like he did the hood latch (M05-2467 #ID) |
|---|---|
| Exhibit 15 Affidavit of Dr. Reich - page 5 | [...] Thus, no evidence of this body fluid from this exhibit was obtained. |
So did he purposely not do this test? Did he do it, but KZ failed to put it in the affidavit? I don't get it...
