Received a ticket for cell phone use when not using cell phone.
Maybe I'm being rash because I feel what I was pulled over for was unjust, but I'm wondering if this is worth fighting especially since I'm already scheduled to appear in court.
I received a ticket for using a cellphone while driving when I was absolutely not using a cellphone. I can't even think of a reason why I would be mistaken for using a cellphone. I also did not have updated proof of insurance (absolutely my fault, I forgot to put my new insurance card in my car) so I already have a court date scheduled for that.
I do not have a dash cam, but I can at the very least provide call logs from my service provider showing I was not on the phone during the time of the ticket. I know that even with call logs that doesn't clear me of doing something like texting, but the Officer had specifically stated that she had seen me holding my phone to my head and then quickly put my phone away when I saw the cop car. Otherwise, though, I'm afraid that this might just come down to my word vs. the Officer's.
I am located in Cook County, IL.
Any advice would be appreciated.
