Wife was rear ended. Other drivers fault. Vehicle was not totaled. As it stands now, we will lose approximately $4500 total from this accident. I'm about to lose my freaking mind. Please help.
Hello all,
I'll try to keep this as short as possible, but I'm extremely pissed off and passionate about this right now.
We live in Kentucky. Wife was in Cleveland, OH and got rear ended by a semi. She was unhurt. This was sometime around January 20.
Due to the vehicle being out of state, my insurance company suggested they handle the claim and will get reimbursed. Sounded good to me.
Vehicle is 2013 Honda CR-V that we bought new. It has no lien. Insurance company (theirs and ours) have valued it around $19,000.
Just picked up the vehicle. It had $11,180 worth of repairs done to it. I begged our insurance company to total it out from the beginning, though they weren't having it due to the difference in value compared to what it's "worth". In my mind, this is bullshit, because I don't give a shit who you ask, the vehicle is now worth substantially less than $19,000.
My insurance company is not willing to help me get a payout for "diminished value". They also are not willing to reimburse me for the car seat we had to buy for $180. We've already got almost $2000 in out of pocket related to this for a rental car and the $1000 deductible which they are supposed to reimburse me for. We bought a new car seat because the police officer in Ohio told my wife she needed to leave it there in Ohio because it was unsafe to use since it'd be involved in an accident. Our fault there. Wife was in a shitty situation at the time and she just nodded and agreed. So not planning on complaining too much about the car seat.
HERE'S THE ISSUE.
Let's just say hypothetically I go to trade the vehicle in and it's worth $16,500 now. Is there any possible way for me to recover this lost value? How is it possible to live in a society where all parties had insurance and the person who was not at all at fault ends up with a loss of even $1, let alone $2500????
In addition, I just found out that they used aftermarket parts on the repair. My insurance company is going to be reimbursed, yet they still authorized this? I complained when I picked up the car because two large plastic panels would not snap in all the way. A technician reviewed the car and told the front office lady they were bulging because they used aftermarket, and they were going to order OEM to resolve the issue. They aren't asking me to pay or anything, I'm just irate that they wouldn't use OEM parts if this was not our fault. I've got three pages of parts that were replaced on the car. Am I going to have issues with the aftermarket stuff that I can't see on the surface? Only time will tell.
The rear glass doesn't match the color of the side glass anymore. The weather stripping is jacked up. I've got a grinding noise when we turn it. The rear hatch / ajar indicator thinks the hatch is open when it isn't. There's a gap between the brake and reverse lights on the damaged side now that doesn't match the passenger /non damaged side. The headliner has water damage it on it near the point of impact that they didn't address whatsoever.
I've got this vehicle that is now worth less than before it was hit, and was shittily repaired at a shop that my insurance company recommended.
I don't want to make a freaking dollar. I just want to break even. Any suggestions at all? As it stands now I'm down the diminished value + I've got these shitty aftermarket parts that don't match! We bought this car new, it was perfectly fine and now I just don't even want it anymore.
Any advice is greatly appreciated. Thank you so much in advance.
