Sued for injuries resulting from traffic accident -- found to be (very questionably) at fault by insurance company. Payment has been rendered for bodily injury at my policy limit, and my rate has skyrocketed. Can I contest this?
Hi everyone,
I think my title here spells out pretty well what I'm asking. The accident occurred a while ago, and there are a significant number of factors that lead me to believe the liability should have been found to be marginal, perhaps 50/50, at worst, for me. However, my insurance company paid out fully my policy limit, essentially finding me to be fully at fault.
Due to the suspicious nature of the claim, I do believe that a court would have found that the gentleman making the claim was not doing so in good faith, but of course for insurers it is more efficient to not go to court in any case unless the claim amount being pursued is very high. At any rate, my already somewhat-costly insurance rate has now gone up by about 80%, and it puts driving, for me, in a much less accessible price bracket. I don't believe that my insurance company is willing (or probably able) to reexamine their findings as far as liability in the accident, though I am pursuing that as well. However, in this moment I'm really wondering whether I might be able to pursue financial compensation or an alteration to my driving record through the courts in my city/county/state. I'm not highly familiar with this process and what my options may be, so I'm all ears as far as any kind of suggestions that people here might have. Also, for specificity's sake and as per subreddit rules, I have been consecutively living in California for the length of my driving record and since the accident in question.
Thank you for reading :")
