AITA for asking my neighbor to move his lawn chairs between our properties?

Not the A-hole

My wife and I have been renting a townhouse for 3 years, and from the day we moved in, my neighbor has put a set of lawn chairs between our properties under some trees in the backyard facing our house. My neighbors leave every winter, so they only set these up in the summer. They asked once, the day of our move. We agreed to it not knowing what they were talking about only to find out the chairs were already sitting there when we went to the backyard. Not wanting to be rude, I let it go, hoping they would ask me again next year, they didn’t. My wife and I have not wanted to use our backyard because of it. Regardless, we have always found our neighbors to be great people.

For the past 2 years we've noticed that he's sitting out there a lot, and the chairs have a good view of our upstairs bedroom window, and our kitchen. Our en-suite is right beside that window, and my wife has come out of the shower a few times, only to squat down because he's sitting there.

Last year I asked him if he could move his chairs next summer closer to his side. He has a deck, and another set of chairs under some trees in his backyard on top of it. They didn't have a problem with it. This year they came back and set the chairs up in the same spot, between the properties. I went over to talk to him, thinking he may have forgot. I asked him very politely if he remembered the conversation we had last year, and asked him if it would be an issue if he moved his chairs closer to his side. He looked shocked when I asked him, I explained that his chairs had a view of our windows and that we were looking for more privacy. He responded with "I'm not a voyeur or anything but I'll move them." I clarified that I was not at all accusing him of that. He continued "It's just a nice shaded spot for me to read."

The next day, I said hi to him in the driveway. Without acknowledging me, he tells me how upset he was about our conversation yesterday and how I accused him of being a voyeur. I again told him that I wasn't, and that I was sorry he took it that way. He goes on to say that "I set up that spot up for everyone, it's just a nice place to read, and I don't understand why you're asking me to move them." I again told him that we just wanted more privacy, and he brings up the voyeur comment again. Again I tell him, I'm not accusing him of that. He turns around and waves his hand and just says "WHATEVER" and walks away.

I feel that because we're renting, I don't have the right to ask him, but the chairs if anything, are more on my side since I have a corner lot. My neighbor has a history of doing things he's not supposed to, parking his trailer out back when told not to by the landlords, poisoning wildlife that pick at his garden, shooting squirrels with a pellet gun, and doing unauthorized renovations. It never really bothered me because he was always great to us, but now he won't speak a word to me since our confrontation.

NTA he is. He's trying to manipulate you by making you the bad guy. He probably is a voyeur.

NTA and I was thinking the same. If you’re not a voyeur and it’s just about the shady spot why, after initially agreeing to move them, did you move them back in front of our windows? And if the chairs are placed directly facing the windows of OP’s place, that is unlikely to be accidental, especially if they were put back in that spot facing the windows after it was brought up.

INFO Whose property are the chairs actually on? There’s no such thing as between properties—it’s one of the other.

There's a clearing between the two houses, but 3/4 of it is on my side.

Okay, but is the part where the lawn chair is placed on your 3/4? Or their 1/4?

My 3/4.

Then you’re NTA. It’s legally your property

INFO I have to withhold any judgment until it is specific if the chairs are actually on your property, or on his. If it is your property, by all means, you can tell him to move them. If it is his property, you really don't have the right. Also, why have you gotten a window covering for your en-suite if you wife is having to duck and cover when she gets out of the bath?

Its tricky because it's a corner lot, there's a clearing between the two houses where they are sitting, but 3/4 of it is on my side. We have gotten a frosted covering for the bathroom window when it first happened, and curtains for the bedroom window. But I do like to open them and have so sunlight in without having someone sitting there.

If it is 3/4 on your property, then you have the right to request he move them.

NTA - they're on your property to start with, so that should automatically mean you get to be in charge of what to do with them. But the (neighbor) man doth protest too much imo about the "voyeur" business.

NTA, time for some cheap shrubs on the property line.
