Stopping a Boris no deal with a VONC has to be done before the summer recess.
So it's been reported that a few Tory MPs are prepared to vote against a Boris government to stop no deal. I get the impression that they aren't planning to do it immediately. But with a 6 week long Recess starting just after the new PM is appointed we really don't have that long left before Oct 31st.
I envisage the following timetable:
July:
23rd Tory Leadership winner is announced
24th May's Last PMQs before seeing the Queen. New PM is appointed
25th Let's assume either no VONC or the new PM wins. House goes into Recess
August:
House is Recess. New PM is negotiating with the EU
September:
3rd House comes back. We're overdue a new parliamentary session so there will probably be a Queen's speech on this day. This will be the first test. If Tory rebels are unhappy with the progress of the negotiations or it's clear the new PM is going to let us crash then they will vote against the Queen's speech. The problem is that the vote on the Queen's speech doesn't usually come until the following week, last time it was 8 days so:
11th House votes down Queen's speech.
Because of the FTPA this wouldn't automatically cause anything, so I expect a formal VONC the following day
12th VONC - new PM loses
---2 week period of parliament trying to form a new Gov---
26th - Parliament hasn't formed a new Gov - GE is called which takes 6 weeks minimum.
7th November - earliest date for GE. Which means we could crash out during the election period with no parliament to stop it. It would be completely up to the new PM, if that's Boris (likely) then he will probably let it happen.
Even having a VONC immediately after recess wouldn't help. It would save 1 week which means we crash out while the votes are being counted.
tl;dr if Tory rebels want to stop the threat of no deal with a VONC, they have to do it before the summer recess.
