Chief Justice Anthony Smellie's previous ruling legalising same-sex marriage has been overturned by the Court of Appeal.
Legislators must provide Chantelle Day and her partner Vickie Bodden Bush with legal status equivalent to marriage, according to the summary note provided by the court today.
"It is a sad day for Caymanians because their constitution has not been properly upheld by their own courts, and for this reason a sad day for the jurisdiction and its future and I would express my utter disgust at the politicised judgement and epic and inexcusable failure of the Court of Appeal to apply correctly the law and find appropriate and adequate constitutional remedy for Chantelle and Vickie," attorney and LGBTQ activist Leonardo Raznovich said in a statement following the ruling.
"The Court of Appeal rewrote section 14 of the Constitution today to help the government."
Raznovich bristled at the notion that the court did not agree with Smellie's previous ruling, saying that the court should have "Remedy to an applicant in circumstances in which the government admitted in court to have breached the constitution and is prepared to do nothing about it".
Raznovich worries that government will not act on the court order, which the court did address in its summary note.
