Friend of mine was falsely charged with sexual assault...
Posted this in AskReddit first, but it probably belongs here. Anyways, here goes.
There is more detail to this story, but I'll give you the highlights. A girl at my friend's school charged him with punching her in her breasts and vagina, tackling her to the floor and, as she puts it, "giving her the impression he was going to rape her." There are several eye-witnesses to 90% of it, including the so-called "tackling", and the other 10% was inside a room (2 minutes). A 30 year veteran of the FBI did a lie detector test on my friend with regards to those two minutes (at his family's request) and the FBI guy said he rarely sees someone be so truthful. Eye witness accounts supported his story, a full psychological exam supported the fact that he would never do something like that, and there was ample reason to believe this girl didn't want her play-fighting, aggressive nature, and other things getting out. So, after her father saw the scrapes she had from that night the next day at her field hockey game, she took that opportunity to make up this story and save face. From what I've now determined, she is most certainly a pathological liar, as her story is completely untrue.
Anyway, his school through him under the bus. He, after all, is a man, and there was no way she, a girl, would make something like this up (see Duke Lacrosse case). Their police force was biased from the beginning, assuming that my friend was guilty and that everything she said was true. This among other factors involved in the way this case has been handled tells me one thing: If you are a guy, and a girl charges you with sexual assault, get ready for the fight of your life, even if there is no evidence to support her charges and even if you DO have evidence that proves your innocence.
After a long and grueling two months, all the girl's lies became apparent (to some extent) and the charges were dropped, both by the college and then by the courts. However, she was also found to be not responsible for making false charges, so the fact that she lied is not being confronted. What's worse, the local press near his school has written about it since the beginning, favoring the girl to the fullest extent. His name was revealed, while hers wasn't (even after her name was written on a federal lawsuit against the school early on in the case, thus making it public info). His hometown was revealed, and she remains virtually anonymous in the public eye. Her actions have severely damaged my friend's reputation, not to mention his family, both financially and emotionally. There wasn't a modicum of truth in her story, and yet due process was never even considered by the school, which is what allowed this to blow up out of proportion. I almost wish now that the trial had gone forward just so that this girl had to take the stand and be forced to face her lies head on. However, as that is not the case, what to do now?
How can my friends reputation be restored? Part of me believes it will never leave him completely, and that it will taint future personal and business relationships, even though he came out on top this time. Even though he did nothing wrong, and was completely exonerated, I think the rumors will persist. This girl may never have to face what she did to his family, but I suppose there's only so much you can ask for.
EDIT: Thanks for your advice. One quick point of clarification that I'd like to make about why I've only shared as much info as I have. You see, this is not my case or my family's case. It's a close friend's case, and its up to him and his family what they want to do. Everything you guys have said has mostly already been discussed by them and their lawyers, as far as lawsuits go, and it's good to hear that everyone is on the same page with what the best options are.
However, as far as getting her name and everything out into public, even though it already technically is public info due to the federal lawsuit they filed against the school with her name on it, I must confess that's originally what I had planned with this post. I wanted the reddit machine to do something about it, but I just learned that the girl's family, who are very well connected and wealthy, threatened to sue my friend in civil court if the girl was attacked in the press. It probably doesn't even matter if its me or reddit or his family that puts her name our their with what she did. I fear that by doing so, I would be at fault for putting them through more of this bullshit, and I don't want to put them through any more than they already have been through. So, thanks for the advice. If my buddy or his family gives the go ahead, I'll be right back on here with the girl's name, number and favorite ice cream. Until then, I think they'll just have to wait and see how things play out. Thanks again.
EDIT 2: Alright, I've gotten the go ahead to post this: http://falserapesociety.blogspot.com/2010/11/must-read-story-sex-charges-dropped.html
It's a blog post about the whole issue, giving the names of both parties, and the school. Do with it what you will. This blogger must have been following the story in the papers for a while, because this came out the day after the charges against my friend were dropped. It doesn't contain all the juicy details about the actual incident and the school's lack of concern for due process. But it gives a good deal of background on how it's all played out.
EDIT 3: I put the above text into paragraphs for kids with ADD. I'm one of them, so I can't believe I was so inconsiderate :)
