Driveway Renovation Work Concern

Hey guys,

I'm the middle of a driveway renovation. Got a number of quotes and picked a guy who was middle of the road but who's work we had seen in a neighbors yard. He quoted for 6" stone with 3" inch of asphalt. Said he would put down the stone and let it settle for 10 days ish.

So they started the work, put down the Belgian block and had the excavator out to dig up the existing drive. As you can see from the photos, some of the old drive remains and there is not enough depth to out down 3 inches of blacktop even without the stone underneath.

I've been looking up videos and how to's all over the web, looking to get some advice on how worried I should be?
