Rudisill vs Wilkie is back under appeal and has nothing to do with your situation. Your situation is covered under a law that is over 40 years old and existed prior to Post 9/11 GI Bill and MGIB. That law, commonly referred to as the 40 month rule, give VA the authority to extend your benefits through the end of a term (not semester) as long as you have at least 1 day of entitlement at the start of a term. This law only applies to veterans. Under this law, VA will pay full tuition to the school for that term and if eligible, MHA to the veteran for the length of that term. The law stipulates Term not semester - so if you sign up for combinations of 8 and 16 week terms within a semester, VA has to stop paying at the first term ending date within that semester. fyi, the STEM extension doesn't count toward 48 months nor does the Vet Tech program as neither one of these programs is part of the GI Bill programs.

To qualify per the law for 48 months, you must establish eligibility for 2 different VA education programs. The STEM extension is 9 months.

How do we go about getting 48 instead of 36? STEM only? Or switch to voc rehab during your last quarter?

I am coming up to my max use of education benefits and currently using my 9/11 GI Bill. I was told that if I run out of benefits mid-semester, the VA will continue paying me until the end. That is what the rep said on the phone, but not 100% sure if she is correct. I am afraid they are confusing 36months with 9/11 with the 48 months max education benefits.  They are basing this info on the  [Rudisill v. Is this true, or has someone else dealt with this issue?
