Car accident advice.

A few weeks ago I was in a car accident that lead to my car being totaled. After waiting for the police report, filing insurance claims, etc... I feel as if the actual liable party for this incident is not receiving blame.

The cause of this was a dump truck that had spilled mud all over the highway leading to less than ideal road conditions. I believe (and I'm not just a prick trying to hide my faults) I wouldn't have rear ended the vehicle in front of me if the road was clear.

Anyways, my problem with the situation is that dump truck is not receiving any blame even though it was their fault that the road was not clear. All of the dump truck's insurance information is in the police report that I have and I was wondering if anybody has advice on this matter or anything that I could pursue in order to be compensated for my vehicles damages.

A few side notes: my insurance claim handler told me that the dump truck was not being pursued because they were not physically involved in the accident. The accident happened on an interstate in Missouri if that helps (I was looking through Missouri traffic ordinances and could not find anything concrete).
