Has anyone tried to argue the 90 day US/France bilateral agreement?

In Croatia for 3 months, and then I'm hopefully spending 3 months in Italy. I would like to then spend 3 months in France. I asked the consulate and they said the agreement did exist, but recommend I try not to argue it.

Just curious if anyone has argued it and had problems.
