[ON, Canada] Bought a Used-Vehicle from Private Seller. Repair Nightmares.
Bought a used vehicle on Kijiji from a Private seller, was supposed to be a gift for my mother. Repairs are way more than initially expected. I'm pretty sure that I will just have to cut my losses and walk away; But I figured I would post here first. I will apologize in advance for the length. I just wanted to include the whole story.
June 14 - First Viewing of Vehicle on Road Side.
June 15 - Find Vehicle on Used Car Website, Contact Seller
June 16- Second viewing. Inspected underside of vehicle as well the engine bay. Everything looked good. Found Frame had been "RhinoGuarded". (Seller stated he "had that done to prevent rust") I've seen this before on vehicles so I didn't ask anymore questions and there was no "visible" damage. Test drove vehicle for over an hour. At all different speeds and driving conditions to be sure its mechanically sound. No service lights on, no Check Engine lights on. Nothing beyond the listed repairs on website.
As follows:
-Front Wheel Bearing, this was audible and I knew it had to be replaced
-Rear Drum Brakes Need Work. Still working at time of test drive but need to be fixed to pass certification.
-E Brake Cable Needed Replacement.
(All of these things needed to be done to pass road certification in ontario.) Agree to make deposit on vehicle and come back once vehicle work had been done and certified/saftied. Received receipt for deposit showing: amount, VIN, Date, and the words "SOLD SAFTIED" with the sellers Signature. Handshake agreement to have it done by June 24th. (I was leaving town this day and wanted to have it on the road before I left)
June 18-I think this is where I messed up. Seller notified me the vehicle wouldnt be ready until well after the time I was leaving. He offered to take 1000 dollars off price if I wanted to pick it up beforehand. I agreed, as all the repairs that needed to be done I could easily do myself at a relatively low cost before I left town. Went and paid remaining cost (less deposit). Received hand written receipt and ownership for vehicle. Towed vehicle to my mothers house and told her I would be back to work on it.
I will preface the next part by saying I am an electrician, not an Automotive Mechanic. But my late father was a mechanic and I spent most of my childhood in his shop. I learned quite a bit from him, and after his passing I learned a little more on my own through the power of the internet. Over the course of the last 15 years I have bought and sold 8 used vehicles. 3 for myself, 3 for my wife and 2 for my mother. This one being the 3rd one for my mom. I was very confident in my ability to buy and sell cars without issues.
Over the course of the next few days I repaired the 2 of 3 things listed above without issue. I was going to have a real mechanic do the rear brakes before the inspection. But they were still functional. So I never even touched the the rear wheels. I also and found a couple more things that the seller didn't mention. All minor things I could do myself also.
-Somehow between our test drive and getting the vehicle home 3 days later the hood cable had snapped. I chalked this up to a rusty cable and just repaired it. NBD
-Broken Lock on one of the back passenger doors.
-Spring on Gas door missing
-1 missing Lugnut on front wheel
June 21- Send my mother to Service Ontario to change over ownership and acquire Trip-Permit so we can move the truck to the shop who is completing the safety inspection. My mother calls me after changing over ownership and tells me the name on the sellers ownership wasn't the name of the guy we bought the truck from. This was very confusing, but there were no red flags on the Used Car Info Pack. But she was right the last owner was not the person we purchased the truck from. It actually belong to the owner of a local HVAC Repair Company. Still very confused about this but we checked with police and they said there were no reports of the truck being stolen. Contacted the HVAC repair company and the owner said he sold the truck to the individual we purchased it from.
June 24- Deliver truck to mechanic for brake job and safety inspection. Mechanic finds rear half of chassis/frame is filled spray foam and then covered with the "RhinoGaurd" I mentioned before. So I told him not to even bother with the brakes because a rotten frame can't be saftied. The last owner covered up the rusted frame work. Check Engine Light is now on also. I received also this info as I was leaving town.
I returned home Monday morning, and have spent the last few days going back and forth with previous owner, explaining all the issues I've found, asking why he never changed the ownership to his name. Essentially accused him of scamming me. As well as trying to find quotes for frame repair. It will cost me thousands of dollar to repair this vehicle. I just wanted to get my mom something nice.
TL;DR Bought a used vehicle as gift for my mom. Turns out the seller was a "middle-man" who never had the title in his name. Found structural damage that was intentionally hidden. Now the repair bill is ten-fold what he advertised in the ad.
Do I cut my losses? Or is there any action I can take?
