Traffic Stop; got stuff taken illegally, or did I?

So today I was riding around town going to pick up a friend, when I get pulled over for not having a seatbelt on. Cool. Officer asks for my information, then immediately tells me to get out of my car because it reeks of marijuana. (Whatever..) I know there isn't any marijuana, but there is a hookah, only EVER used for tobacco. So I spend an hour while they tear my car up, and even an investigator comes and tests some of the tobacco pieces in the box for my hookah. All false. They release me and let me on my way, but seize the hookah (I signed.)

My question is, is there any way to get it back if they didn't charge me with anything but a seatbelt violation? Who should I contact?
