Vivint Solar Inc. has struck a deal to end a Utah federal court suit from a former human resources manager who claimed she was pressured to join the Mormon faith and paid less than her male colleagues.

An attorney for Adriana Clark, a former human capital manager at Lehi, Utah-based Vivint, told Law360 Tuesday that the details of the settlement are confidential. Clark apprised the court of the resolution in her Title VII and Equal Pay Act suit on Monday.

Clark filed suit in February 2017, claiming she was underpaid relative to male Mormon counterparts and was eventually fired in retaliation for complaining about the pay gap. Clark alleged she was the only non-Mormon employee in her department and she was pressured by her manager to get involved in the Church of Jesus Christ of Latter-day Saints, which is widely known as the Mormon church.

Co-workers made negative comments about nonmembers of the faith and Clark's male colleagues wondered why she, as a woman, had a job when their wives stayed at home, according to the lawsuit.

Clark said Vivint hired her in November 2013 and promoted her twice in the next two years, but she didn't get pay raises or an office, though male managers did.

Clark was fired in 2017 when her position required her to relocate to the eastern region and she declined to do so, which she alleged was in retaliation for her requests for higher pay.

The company said in a January 2020 motion for summary judgment that it had a legitimate reason to require Clark to live in the location her position served. Vivint also argued that Clark did not identify a male manager who performed similar job duties and made more money than her.

Clark alleged that when she was fired, she was one of three women holding managerial positions at the solar company, and that one of the other women also ended up leaving the company due to discrimination.

Counsel and a spokesperson for Vivint did not immediately respond to requests for comment Tuesday.
