Property of a deceased person
My partner lived with me for three years before his sudden passing, in a US state that does not recognize common law marriage. Outside of it being his listed address of record like on his license, his name wasn’t on anything- not the mortgage or bills and he had no renters insurance. At the time of his passing he had maybe $1k of personal property on my property. He has been deceased for more than 30 days. There was no will, to my knowledge probate has yet to be filed if it is going to be.
His mother would like to come into my home and go through every single room until she is satisfied that she has all of the things that were his, as they are hers as his next of kin. She does not trust me to be the one to decide what was his. I have repeatedly offered to give her any items that she requests, but he was a man that frequently traded or just straight gave away his possessions so several things may not exist anymore. She has not offered or accepted any compromise, she believes it is her right to be granted full access to my residence and remove whatever items she decides on.
My intent at this time is to pack up as much of his belongings as I can and give them to her. Is there anything further that I would need to do? Is there a way in which she could force her way into my home? Am I able to remove my property from the home before she has a chance to force her way in?
From my understanding of her, she is not above fabricating evidence to fit her narrative. She is incredibly controlling and telling her that for me to heal and process my own grief I need to do this without her influence has obviously triggered her. She has a personal attorney and bottomless pockets when it comes to getting her way.
Any advice outside of just letting her do whatever she wants is greatly appreciated, thank you
