At a loss of what to do. [TN]

Constitution

This is a throw away account, I mean obviously.

I am a security guard in TN and run a company. One of my accounts is a high profile account. The local goverment (DA, Mayor, The Police, etc.) are attempting to shut the property down. They are claiming the TN Public Nuisance code for this, claiming 1600 calls to the police department. Now, the call period depends on who you ask. The number has changed a lot. I digress.

Its safe to say, this is a challenging position to be in. I have testified in court on behalf of my client. I have pissed off everyone from the State to local goverment for being honest on the stand. I will not lie under oath, even if it goes against my client. The truth is the truth.

I have had the privilege of going out and working the property myself recently, while waiting to hire someone to take the place of one of my former employees. Being in the position I am in, in the company, I know a lot more than the average guard. I have met with many of people to learn and understand local laws, as well as read extensive TCA code. I have read the most current city ordinance published and the police departments handbook. I like to be educated on subjects, I find law interesting, and I rather not get my company sued.

There was a shooting on the property recently. I was off property getting lunch and the property manager called me. The shooting occured at 1215, a call was placed to the police at 1217, I received the call at 1221. I got back to property and saw a lot of people outside, construction is going on so I questioned if a shooting occured. I interviewed staff still on property and called my partner for back up.

My partner got to property and we went together to interview multiple people and finally figured out where the shooting occured. We found shell casings and found bullet holes in a unit. We check records and the unit is supposed to be occupied, but double checked with the office. When we arrived at the office, they were searching for the name of the suspect and they had recording of the subject admiting to the shooting. The male in question admitted to attempting to shoot the property manager because of an eviction notice. My partner placed a call to PD.

The office found the name of the subject, and I search criminal records and saw a felony warrant for the suspect in question. I checked the county site and confirmed the warrant is active. I was hopeful the local PD would take the matter seriously, make an arrest and help us get this particular person off property sooner.

PD arrived on property and spoke with my partner and myself. The Officer seemed angry and rolled his eyes when asked questions concerning this. We then find out, a call was holing from 1217 to 1450, concerning shots fired on property. When we take officers to collect the shell casings, no welfare check was preformed on the resident where the bullet holes where. Just a quick look, and a random male stated the holes have been there. My partner checked where the shell casings were found and found one the officer missed. The officer responded to my partner "You are going to find a lot of shell casings over here, next time just throw them over the fence". I was in shock, but said nothing. The Officer then stated he was going to get all of this information and write a memo, since there is no victim. I went through and explained all the laws that were broken, and I felt like it warranted a report. The officer rolled his eyes and said that no victim, no report. I then asked for the memo number for my reports, he reluctantly have me the information and left.

I updated the office on the situation, upset. There are a few "victimless" crimes broken, and I felt like more could have been done. I wrote up a report and sent it to the property manager. When I sent it to her, I advised to send it to their attorney to see what we are up against. I told the property manager I planned on going to the local police station and speaking with the watch commander, to try and come up with a game plan going forward to work together and voice my concerns about the most recent incident.

I went to the station and asked to speak to someone higher up than the desk officer. The desk officer stated they were on lunch. I understood and left my information, raised my concerns, and was told a LT would call me later on in the day. I explained my biggest concern was, that if this subject where to shoot again and injure someone, the police would be quick to blame the property, but a what point are the police going to be held accountable for this? The desk officer assured me that a LT would call.

I go to lunch and come back to the property. I go to the office when it opens back up and speak to a vendor and the property manager. While the vendor was walking out of the office, he stated there was a police officer there. The property manager and i were confused, because no call was placed. When I walk out, I see the officer I complained on less than 2 hours before. The first words out of his mouth were, "What did I do wrong yesterday?" I told him, "You were unprofessional, your partner told us something that would get us charged with a crime, but we now have a way bigger issue, you came to my job to confront me." The officer kept making excuses for his behavior and I kept shooting down his excuses. He finally check out at dispatch and requested a supervisor to make scene.

The property manager realized pretty quickly what was going on, and recorded everything. The leasing agent was starting to pick up on everything. The officer attempted to take me away from everyone else to "talk to him". I told him no and walked outside to my vehicle. The officer followed me outside, yelling at me, and approached me with his arms out while I was bent over in my vehicle, getting a sip of my drink. I turned around and he back away from me with his palms facing me.

I call my partner, freaking out, because I had no idea what to do. During this time, the officer kept interrupting my conversation. The property manager came outside and continued to record. After about 10 minutes of this, another officer pulls up and blocks me from driving away. The second officer realized what was happening and refused to exit his vehicle. He also looked angry, shaking his head, and stayed on his phone.

The LT came on property, completely blocking any way for me to exit the area. The LT also proceeded to defend the officer for coming to confront me. He stated my claims of intimidation and retaliation are unfounded, but would believe me if it was another officer. The LT told me that IA would not investigate any of this. When I told him if IA will not help me, I would reach out to the DOJ. He quickly changed from the officer was trying to talk it out to he was following up on a report made. I then stated no report was made, so that claim is false.

The LT then asked the officer if he went to the station that day. The officer said "no.... well, yeah, i had to pee... I did to turn in video evidence of the thing." The LT then asked the officer how he found out about the problem with yesterday. The officer stated "Some random guy at the gas station said security at [property name] said there was an issue". I asked what guy and what gas station. The officer stated "I dont know, some guy and the Shell down the street." I explained to the officer i have never set foot at that gas station. I also asked the officer "A recorded confession of someone shooting on property is 3rd party information and doesnt warrant a report, but some randpm guy at a gas station I have never been too, is good enough 3rd party information to confront me?" The officer then told me yes.

The LT kept teying to defend the officer and I gave up making my point. The Officer then asked if I accepted his apology. I told him for the incident before, I dont care anymore, but for today, absolutely not. This is a way bigger issue. The whole situation lasted 30+ minutes. I was de facto detained during this time.

I called attorneys in the area, trying to navigate all of this. Every single civil rights attorney turned me down because I didnt die. My 1st amendment right was violated. I was de facto detained for an unreasonable amount of time, by 3 officers. I was also retaliated agaisnt by my government for speaking against my goverment. I did take the advice from one attorney and called IA. I find out tomorrow if they are even going to investigate the issue. Yes, this is what I was told. I did find out that there is body cam footage from the beginning to end. I do have to contact their legal team if I want the footage, from the FOIA. None of this is making sense to me and I have no idea what to do anymore. Do I need to find an attorney to help? I honestly dont care about damages, I just want someone to be held accountable for this, for what is happening on a property that desperately needs help.

TL;DR - Filed a complaint on how a situation was handled by PD. PD detained me for 30+ minutes, confronting me and telling me this isnt an issue(confronting me). IA investigation depending, but they may not investigate. What the hell do I do?
