Should I file a small claims case against my apartment complex?
I'm a college student living in an off-campus apartment complex, and since I'm working in a different town over the summer, I relet my apartment to another student. I was charged a $350 "relet fee" which was required to transfer my lease to the new resident. However, I was reading the details about reletting in my lease and it says that if the office consents in writing to the new resident taking over the lease, then:
- "A reletting charge will not be due;
- "A reasonable administrative (paperwork) and/or transfer fee will be due..."
I asked the office about this, and they basically said that even though they call the $350 fee a "relet fee," it's actually the "transfer fee" listed in the second item. This seems very misleading, and as a college student $350 is not a "reasonable" fee. (It's exclusively students living here.)
I do have an email from the office that I think shows written consent for the new resident to take over my lease. They also make the new resident pay a second security deposit and a $200 application fee, so I would imagine this money could cover any sort of administrative fees.
Do I have grounds to file a small claims case in this situation? Thanks in advance for your advice!
