Why are figure releases not more current?

Why is it that Black Series releases are so far out of date when compared with Marvel Legends for example?

I understand sometimes working off early concept art can result in inaccuracies but surely there's a happy medium between releasing something prior to or close to release like Marvel Legends, and releasing figures based on shows/movies a year or more prior.
