[Request] Need advice about an upcoming court date, NYC
A few months ago I posted on reddit in a throwaway to help me with a little tax issue I was having with my "father". Read here for the details http://www.reddit.com/r/AskReddit/comments/qxf16/a_sobering_story_a_humble_request/
As per the advice of those that commented in the thread I did file a restraining order, and received it no question. I called the IRS agency, though and was not able to get any information on whether or not he has tampered with my tax papers during the filing process and have not yet received my federal check. A court date was set earlier in May to present our cases and to see if I still needed the restraining order. The long and short of it is that I still have the restraining order in place, however he is allowed to come into my place of residence; just not allowed to talk to/harass me in any way.
Where this thread comes in is during this court proceeding, he lied to the court telling them he lives in the same residency as I do and that I do not live here even though I have lived here all the 22 years of my life. The judge then asked him if he would like to make a court date in the future as to prove these accusations and he accepted. So on July 18th we both have to come into court and prove that we live in the same place. SIGH. He does not live here. He moved out when I was at least 15 because this is a 2 bedroom apartment and (learned this through a family friend) my grandmother asked him to move out. I am not too worried about my own need for proof, but I am frustrated because for all intentions and purposes, he probably can prove the same thing as well.
His mail is set to this address His drivers license has this address The studio apartment he currently lives in probably works in a way that he can pay the manager in cash, therefore leaving no paper trail of his current address He only owns a cell phone
The ONLY things I am holding out for is the fact that he still has my tax papers and has not given them back, and lease of this apartment I live in, which I am reluctant to ask of my grandmother because I do not know if she will let me make a copy of it, but if she does not she is obstructing (or so I was told). Please, I need advice of anyone with experience in this kind of predicament. Is there anything I can do, any papers I can get that will prove that he does not live in this apartment?
TL;DR Need advice for a court date in which I have to prove my "father" does not live in the same place I do, when he has been covering his tracks so well it looks as though he does live here.
