Question Re Solicitor Enquiries
House buyer here in England.
We are purchasing a property and have a Solicitor carrying out the usual enquiries. The last of these are outstanding, however each time we go back around the loop of asking the sellers Solicitor for information about two to three weeks passes as the request goes all the way through to the seller and back. Sometimes this happens more than once for the same item. I am aware that this is likely not unusual.
The outstanding items are fairly trivial, and given the increase in mortgage cost if this fell through we'd rather just sign something that says we accept any risk and press ahead. Our Solicitor is adamant that she needs all of her checks back however. I don't want to make it seem like we are being at all trivial, basically everything bar a couple of small items has come back that I do not believe are legally required to move ahead with the purchase, and we've had a full survey etc etc.
Is she correct that she can make this decision, or can we overrule in this instance? What points must she absolutely have to have answered from a legal perspective? My concern if it does end negatively for us in some way, the impact is all on us as buyers who would have to find another property and fork out significantly more for a mortgage so surely we should just be able to instruct accordingly here. I know the Solicitor should act in our best interest, I just feel there's two trains of thought here as to what our best interest actually is.
Thanks.
