I was wondering if it makes sense to rebutt the position statement during the eeoc process?
The pros from what i understand:
-
Instill fear in the employer with your evidence to force them to settle and or offer more money.
-
Potentially get the EEOC to find cause, with could help your settlement and or case.
The cons:
The eeoc really can't force the employer to pay or rehire you.
If you rebutt, you give the employer all your evidence. As a result, they have a chance to get their lie straight before you file in court.
It's my understanding the courts are lenient with employer's lying, but your lie will end the case. So they can sometimes get away with changing their reasoning
