Getting a report while they have a identity investigation going

There has been extensive identity fraud perpetrated against me . I flagged the account and they are doing an investigation. I asked for my credit report but they said because there is a current investigation they cannot give it to me. My friend told me that if you sign up for equifax premium , they have to send you your consumer report, even if you have an open investigation. Can anyone verify if my friend is correct or not. I need to keep on top of what the identity thief is doing.
