"not guilty of attempted murder ... guilty of the lesser charge of negligent discharge of a firearm"

Well, that's just California in a nutshell, all about the guns.

Lord_SealandNot a(n) LEO / Unverified User•

Same thing happened in Virginia a couple years ago. CA threw the case on purpose, suspect shot an officer twice from six feet away on BWC and got acquitted of attempted capital murder. Convicted of discharging a firearm in an occupied dwelling… which was occupied only by himself and the officer.

No additional charges for possession of gun with high capacity magazine?

KeystoneGrayHospital YEETer / Not a(n) LEO •

So the logic goes that they discharged the firearm in a physical altercation for reasons other than using lethal force in said fight? Interesting. So the precedent is set, then. In California, if you miss while attempting to murder someone, just say you were firing warning shots because you were scared they might retaliate for you attacking them. 🤔

“Young's defense attorney, however, argued that McCarthy had no lawful reason to do what she was doing, and therefore his client was acting in self-defense.”

So to summarize:

-Deputy is dispatched to a priority 911 call.

-Arrives on scene to see caller with a knife and the son running away.

-Son runs towards officer in a threatening manner.

-Deputy attempts to detain the son and Terry frisk him.

-Son becomes combative with Deputy, beats her up and takes her gun and fires at her face then fires again.

-Backup responds and shoots the son and then take him into custody.

-Son’s lawyer makes above quote. Says deputy had no legal right to do any of that and son acted in self defense.

-Jury agrees and decides they beating someone up and attempting to shoot them qualifies as self defense. Then decides to charge him for discharging a firearm.

Words don’t do justice for how dumbfounded I am.

He was not guilty for attempted murder but a hung jury for all of the other charges. Probably will go to trial gain.

It's a wonder California still has police officers

foamboardsbeermeNot a(n) LEO / Unverified User•

CA police officers get paid very well compared to the rest of the nation.

42
krispy_dongleNot a(n) LEO / Unverified User•

Try this. Divide an officers salary by the average cost of a house in that area. You will be shocked at what you find for California.

105
foamboardsbeermeNot a(n) LEO / Unverified User•

Yeah thats a fair point but its still an impressive salary and it carries into your pension. Some people in my academy were making $50/hr as a trainee. It’s definitely not hard to survive off that. When you retire take your pension to another state and live like a king. Just my thoughts, but of course you have to deal with strong anti-cop bias and arguably the worst homeless epidemic in the nation.

gojo96Not a(n) LEO / Unverified User•

I’ve met many CA officers who retired and left CA. Their money goes far in other States. There’s a reason many leave State after retirement.

56
ttedderOPNot a(n) LEO / Unverified User•
  1. Work as officer in CA, struggling to afford basic amenities due to exorbitant CoL and tax rate
  2. Get high 3 pension and move to Wyoming
  3. Work as deputy in little quiet county making 40-60k/year while collecting CA pension

2BlueZebrasTrooper / Drives a Desk•

A shit salary in a high CoL state becomes a great retirement anywhere else.

14
KnightFan2019Not a(n) LEO / Unverified User•

$250k is a very liveable salary if u ask me

3
Pikeman212a6cCustoms Officer•

No one is saying it isn’t an extremely good salary. But if you are a SF officer looking to live in a reasonable commuting range of your work an enormous share gets eaten up by housing. It’s not an issue unique to law enforcement.

3

Oh don’t worry. They’re trying to fire most of us for incidents that are entirely within policy.

So like... we're supposed to riot and burn down cities now, right?

143
wowsosquareNot a(n) LEO / Unverified User•

I wish we would at least have some nice, *actually" peaceful, actually non- fiery protest events after these shocking rulings. Hell, we should have them when cops are shot or ambushed. I would go to some.

37
Thoughtful_MousePolice Officer•

I would rather people voted, but between the myopia and short attention span they'll have forgotten by election time. Given how little most people know about their own government they probably don't know what offices need to change, anyway.

20
wowsosquareNot a(n) LEO / Unverified User•

Now that's some hard core defeatest thinking right there, Tex.

You're probably right, but hey, look at the massive changes the idiot anti cop anarchists in suits got done with some PR, some protesting, and some elections. Why couldn't we do that, just without all the Burning, Looting, and Murdering?

6
RcreccNot a(n) LEO / Unverified User•

Meh, if you think any politician supports LE, think again. For example, look at what they said about the officer who shot Babbitt.

To politicians, left and right, LE are political pawns. Nothing more. Things have changed and I don’t know if or when it will get better.

4
Thoughtful_MousePolice Officer•

You're probably right.

So what exactly is your point? That I should lie to myself? Why?

1
Particular_Rub_739Not a(n) LEO / Unverified User•

Well we could but then we would all have to miss a day at work and well, let's be honest most of us need our job because we have to feed ourselves and our families. Maybe if we all schedule our days off we could find a day to do this

Judges and juries are filled with a bunch of libtard idiots with an anti-police bias. I wish I was shocked by this verdict, but I’m not. It’s heartbreaking.

65
Freethinker_76Not a(n) LEO / Unverified User•

Nah, skip the politics on this one. They just hate police. We go through the same in DC. They let criminals off all the time but once an officer screws up, the DA is licking their chops ready to prosecute.

23
TheThotKnightDeputy•

It’s 100% politics on this one. People elect these activists who who want to “rehabilitate” rather than punish or hold people accountable. Don’t get me wrong they do hate cops. However when these activists run they make their position very clear people still vote for them.

22
Freethinker_76Not a(n) LEO / Unverified User•

I agree with you, especially on that last part. A prime example of that is what is going on in cities all over the country where mayor's and city council strips the tasks of police and tries to delegate those tasks (curfew enforcement) to civilians. Of course, with unsuccessful results.

It's California. I live here, and don't expect anything less.

I pray Newsom doesn't even get near the Presidential candidacy. The rest of the country doesnt need that disease of his spreading anymore than it already has.

29
SnooWonderNot a(n) LEO / Unverified User•

This doesn't make sense unless you consider it's directed at a cop. That's the only way this is not attempted murder. Anyone who shoots at someone running away (outside of someone committing a felony in Georgia) would be committing attempted murder.

This makes me sick. People in California are mentally ill. (And I'm talking about the jury.)

The fact that a jury found him not guilty of attempted murder is not even surprising. The people in these Dem-run areas fervently hate police officers. Very unfortunate that her condition forced her to retire. I wish her the best.

Didn't we just have a post on this a few days ago, or am I hallucinating? Or mixing up cases?

Didn't they find him not guilty of attempted murder because he fired in the opposite direction from which she was running? Like, she ran north, and he fired south, or vice versa?

And I seem to recall that the other big charges were a hung jury, so they'll have to retry them?

https://abc7.com/victorville--san-bernardino-county-sheriffs-deputy-found-not-guilty/13352182/

Yeah, here we go. Cause I remember the defense attorney getting roasted for saying she wasn't allowed to detain during an investigation.

Edit: I think it's pretty telling that most of the top level comments are unflaired.

According to the deputy, the perp had the gun pointed at her while she was still on the ground and pulled the trigger only for a malfunction to happen.

Straight jury nullification.

That’s the only thing that can describe what happened here.

And that jury nullification is brought to you by ACAB.
