On March 11 at 9:30am Rome time, the Corte Costituzionale will be hearing the referral from Judge Alessandria Torino that questions if the retroactive nature of DL36-L74/2025 applying to those born before its passage adheres to the Italian constitution and EU jurisprudence.

Welcome to r/juresanguinis's second ever watch party! We wish it were under better circumstances, but this hearing has been anticipated for the last year and it's finally here. Tune in to the Corte Costituzionale's livestream of the hearing and join us in the discussion in the comments of this post (sorted by newest).

To be clear: the Corte Costituzionale is the one livestreaming the hearing. We, the sub, will share reactions and host discussion in the comments of this post about what we're watching on their site.

Background

There are four cases involving DL36-L74 that have been referred to the Corte Costituzionale (see here) and this hearing will only address the first case, the Torino referral. The second case, the Mantova referral, will be heard on June 9, 2026, while the final two cases, both from Campobasso, do not yet have hearing dates set.

There's been many posts discussing the meat of the Torino referral (summarized here), but the short version is that it's a very precise challenge. It only raises the question of the DL's applicability to those born before its passage, namely:

  • Art. 3-bis) limitatamente alle parole “anche prima della data di entrata in vigore del presente articolo”
  • The March 27 deadline in Art. 3-bis) a), a-bis), and b)

FAQ

  • Is the Court going to issue a ruling on March 11?
    • No, this is just the hearing.
  • Is this going to be the only hearing for the Torino case?
    • It's currently the only hearing that has been scheduled for the Torino case, but the Court may decide to schedule a subsequent hearing.
  • Is the Court going to rule on the minor issue?
    • No, those are wholly separate cases, filed pre-DL, at a different court. That hearing will be on April 14, 2026, at the Cassazione.
  • When will the Court issue a ruling?
    • We don't know. They could issue a ruling before the Mantova hearing in June. They could wait until after the Mantova hearing. They could wait until after the Campobasso hearing(s). We simply have no way of knowing what they're going to do. Anyone who claims otherwise is speculating.
  • If the Court rules that the retroactivity portion of the DL is unconstitutional, what does that mean?
    • It means that the DL would no longer apply to those born before its passage, which would be effective as of the date of the publication of the decision.
    • It would not affect children born on or after the date of its passage, they would still be subject to the restrictions imposed by the "beneficio di legge" category of citizenship. The Mantova case will be addressing this part of the DL.
  • If the Court rules that the retroactivity portion of the DL is not unconstitutional, what does that mean?
    • It doesn't necessarily mean that the fight is over. There are still three other cases on the docket that are challenging the constitutionality of the DL and are much broader in scope than the Torino referral (see here).
