Card listed as EX with ink on a bump, Cardmarket refused to do anything about it

Hi,

A week ago I posted this. The card I bought for 35€ was listed as EX, when I received it I noticed a bump with blue ink on it (pictures can be found here), so I decided to ask to the seller what could we do but he never replied, on the other hand I asked to Cardmarket to help me find a solution because this is what we can find on their guidelines :

Blackened Borders

Tampering with the border of a card will always result in a card that is in Poor condition. Blackening the borders of a card is mainly an action of destroying its value in an attempt to improve its looks. However, precisely for that reason it is also done to sell a card for more than its inherent, remaining value. This is considered fraud, and will lead to exclusion from Cardmarket. If a card's borders have been altered ALWAYS make sure to offer it as Poor. This is particularly important for Unlimited cards that have a blackened border. Offering these as Beta cards is a fraud attempt and might lead to legal consequences including criminal prosecution. Don't do it!

Even tho it's blue and not black I don't see no difference, we can believe that it hasn't been inked on purpose, but still, it can't be EX.

Today Cardmarket gave me an answer :

Hello X,
Thank you for your message, and please accept our apologies for the delay in responding.

If the card does not have any other defects, we consider that it is correctly graded as Excellent, and we are unable to grant your request.

We are now closing this ticket, and no response is expected.
If you encounter any other issues related to this matter, please contact us again by reopening this ticket.

Kind regards,

I really don't get how they think it's still an EX, I reopened the ticket but I feel like I'm gonna lose these 35€, it's not much but for a card I will have to buy again it makes me crazy.

Is there anything I can do ?
