On June 9 at 3pm Rome time, the Corte Costituzionale will be jointly hearing the referrals about DL36/L74 from:
- Judge Bertola at the Tribunale di Mantova - within the context of "beneficio di legge" minor children: citizenship is a right from birth, deprivation of voting rights and legislative representation, etc.
- Judge Carissimi at the Tribunale di Campobasso - political motives and procedural abuse.
- Judge Casillo at the Tribunale di Campobasso - political motives and procedural abuse.
Welcome to r/juresanguinis's third watch party! We wish it were under better circumstances, especially after the last hearing, but let's give it another whirl. Tune in to the Corte Costituzionale's livestream of the hearing and join us in the discussion in the comments of this post (sorted by newest).
To be clear: the Corte Costituzionale is the one livestreaming the hearing. We, the sub, will share reactions and host discussion in the comments of this post about what we're watching on their site.
Background
There are four cases involving DL36-L74 that have been referred to the Corte Costituzionale (see here). The first case, the Torino referral, was heard on March 11, 2026 and the [unfortunately, negative] decision was released on April 30, 2026. This hearing will address the remaining 3 referrals from Mantova and Campobasso.
The Mantova and Campobasso referrals argue multiple aspects of the law are unconstitutional and are unique in scope from the Torino referral's focus on retroactivity. Additionally, the Mantova referral is unique in scope from the Campobasso referrals, which are similar to each other. Both Campobasso referrals are 3rd-4th gen 1948 cases while the Mantova referral involves a family from a successful 1948 case arguing that their child should be JS from birth instead of by beneficio di legge.

FAQ
- What does DL36/L74 stand for?
- Decreto legge n. 36 / legge n. 74, the laws that completely reimagined the legal concept of Italian citizenship by descent on March 28, 2025.
- Is the Court going to issue a ruling on June 9?
- No, this is just the hearing.
- Is the Court going to issue a statement shortly after the hearing like they did for the March 11 hearing? If so, when?
- Only the Court knows if/when they're going to do that.
- Is the Court going to rule on the minor issue?
- No, those are wholly separate cases, filed pre-DL, at a different court. The hearing for that was on April 14, 2026 at the Cassazione and we are still awaiting the outcome of that hearing.
