My mom refuses any and all treatment regardless

Hello all,

I am new to this group and this is my first post. My mom was diagnosed with Type 2 diabetes about two years ago. She is 62 and I believe if she had taken care of herself she would not be in the predicament she is in. She has gangrene and necrosis in toes and both feet, mostly her right foot. I was able to have someone take her to the local ER where they gave her antibiotics but due to “patients rights” she was let go because she said so. My mom is and has been mentally incompetent for many years, yet the hospital let her go. She’s about to lose her foot and toes and possibly her life as he BG ranges between 450-650 any given day. She constantly refuses any medical care and seems content living her life rotting away? Why though? Isn’t there something we can do to enforce care, I live multiple states away and my sister whom lives there is just selfish and won’t help. I don’t truly believe she wants to die. But, she sees herself rotting away, she’s clearly not competent at this point to make her own patient right decisions. It’s like her brain is whacked. She used to care but she has stated to us family member she wants to die at home like she doesn’t believe she can be cured. She listens to no one and refuses treatment every damn time .

And the hospitals are ok with that even with her mental status. What gives? What can we do to so to force care on her, she really needs it and me being her daughter knows she doesn’t want to suffer like this, we should force her to get the help she needs and stay on a regiment? She is located in Texas btw, in a rural location. She already has gangrene and necrosis in her toes and both feet and to me looks like they can’t be saved, but I want to save her life I just don’t know how being located so far away. I have a sister there who just ignores it, like whatever. I’m located up north with my government job and currently on orders. Little I can do myself besides break orders but I’m not sure it’ll do any good as she doesn’t listen to me or anyone. She’s adamant at just staying home rotting away yet telling us all “she’s fine”, which of course she isn’t. What can I do being from out of state, I’ve heard of petitions and I would do one in a heartbeat but my sister who lives there holds the power.

Please tell me what I can do as I am very sad and know I will be losing her any day now. Thank you so much for reading.

Do you have documentation from doctors supporting that? I have no idea what Texas laws are.

If your statement is valid I suggest you investigate the legal situation to see if you can get authority to manage her care. But be aware if you succeed that will place a responsibility on you to do that properly.

Yes, it is documented from her last hospital stay and the same hospital let her go home stating “patient rights”, even though the last time she went in she tried to commit suicide.

You need to talk to a Texas lawyer about this one. There are ways to get someone declared incompetent but I don't think anybody here would know what they are. Especially considering that the laws vary from state to state.

You could try r/AskALawyer, they might be able to help.

I really hate to say that you should prepare yourself for the worst but you probably should. 450-650 are horrendous numbers. And gangrene can be fatal if not dealt with immediately. Just don't blame yourself for any of this. Your mother made a series of decisions that led her to be in the state she's in, that's on her, not you.

Good luck.

Ask to speak to the medical social worker next time you take her to the hospital. What you're looking for is to declare her medically non-decisional and/or have a guardian appointed for her. You can actually have a state guardian appointed if you or your sister can't do it.

We did that and social workers are going to do an assessment at her home. I’m hoping they can do a psych evaluation since all other avenues don’t seem to be working. She truly believes she is ok and she saw a foot doctor who tried to keep her there and do surgery to remove her foot as it has severe gangrene and the infection is moving up her leg. The doctor pleaded with her to stay as did other medical professionals but she refused and since she knew the time and place they deemed her competent and let her leave. The doctor said she will have to have her entire leg amputated in a week and she don’t do that she will not be alive for Christmas. We have social workers priority on her case and we are praying they can do something. Thank you for your advice it is always welcome.
