Shitty neighbors get raked over the coals by local media and the public, drop lawsuit*

Guess they realized they were being dicks..

Too bad they're still dicks though

53

More precisely they realized they were being outed publicly as dicks.

The Gottliebs’ neighbors, the Costas, purchased the playscape for their child Colton, who was born with Hurler’s syndrome, a genetic disorder in cells, tissue and organs for which there is no cure.

So your neighbor’s daughter is terminally ill (Wikipedia says most victims only live to age 12), and you file a lawsuit over the playscape that is giving her her last bit of fun because it’s visible over the fence.

You had better make that little girl have a fantastic time by way of apology. Disney vacation, visits with puppies, any video game she wants.

49
j_i_x_r•

so your neighbors broke their HOA and community guideline rules, that everyone agrees to when they buy property there, and your neighbor tells you to fuck off because their kid is sick, and that takes precedence over a legal document they agreed to not do the shit they did.

But yeah, sounds like the both the people involved will have a resolution in a few years.

Most HOA docs have an exception clause for a reason.

37
j_i_x_r•

you can get variances with HOA approval, which seems to not have happened.

The lawsuit from the Gottliebs says installation of large objects, like a playground, must be approved by the Estrella Subdivisions Architecture and Design Review Committee, and that protocols weren’t followed in this case.

All the butthurt nimbys here would be equally sue happy if their neighbors were pulling the same shit. Check your local neighborhood app, yall freak the fuck out if there is a dude just walking down the street who isn't white.

-45
DougiePness•

This is why you have no real friends and your family doesnt like you

14
ashdrewness•

Why was the neighbor suing then instead of the HOA going through their usual means? Sounds like the HOA leadership didn’t wish to pursue it (effectively granting an exception) and these neighbors didn’t like that decision.

27
j_i_x_r•

effectively granting an exception

no, thats not how it works at all.

not pursuing or enforcing, is not the same as approving. If the HOA is not enforcing their rules, then anyone who is part of the HOA, can indeed sue an offending party.

What is this guy a HOA lawyer

22
ashdrewness•

Depends entirely on how the bi-laws are written. Some give full discretion to the board and all members must abide by their decision. I highly doubt the plaintiffs didn’t begin their grievance with the HOA board, so it’s likely the board chose not to enforce which a good lawyer for the defendant would say is a ruling of approval. So again, depends on how the HOA bi-laws are written. In my community it’s how I stated above; discretion of the board or a community vote.

HOAs are bullshit and you’re a bullshit person it sounds like.

22

Yeah, fuck that guy. I’d paint my house rainbow, and add a massive unicorn horn just to spite him.

10
lazerdab•

HOAs suck until it's time to sell your house and you're thankful there isn't a dismantled car on the front lawn of the neighbor. But for real, there's always exceptions.

Elect me HOA president so I can disband the HOA. Everyone wins.

8
bmcthomas•

Except that they didn't break any rules. They received approval from the HOA, if anyone bothered to read the original article.

5
j_i_x_r•

then you must have missed the point where one party argued that they didn't receive approval, which is the whole reason for taking it to court, to have a 3rd party judge over it.

-2
bmcthomas•

In this article, the HOA confirmed that the family did "submit the playscape properly for review". https://www.bigcountryhomepage.com/news/georgetown-family-faces-lawsuit-over-playscape-for-terminally-ill-son/

I don’t see how that awesome playscape could be considered an eyesore anyways. It’s super nice.

The view of their backyard is more important to them then a young boy enjoying his last few years. Terrible.

“I did not want to drop this because I did not want anybody thinking that it was the bullying that got this changed,” said Gottleib.

“TOO BE CLEAR- I am still the biggest asshole of all time, do not let this news fool you. I would punch that cancer kid square in the jaw if I saw him walking in the street. I simply do not think there is another human being as shitty as me who would allow me to win this lawsuit.” -Gottlieb, probably

Good, I guess I don't have to continue wishing bad things upon them 😜

That shitty family protests anything and everything - https://www.statesman.com/news/20180102/proposed-60-million-plan-for-georgetown-airport-angers-neighbors

They live on a 1 ACRE lot and are whining about "obstruction of view."

-3
j_i_x_r•

i'm going with an "everyone sucks here"

the fact that the kid is sick doesn't matter, they were breaking their HOA. and the neighbors have every right to have the rules enforced that they all agreed to.

You'd be shocked the amount of minute shit HOA and neighborhood restrictions lots have if any of yall delt with them all day for work.

If the kid wasn't sick it would be a non story.

The family sucks for fucking over their neighbors rights

the neighbors suck for suing the family

and the media sucks the worst by acting as if the neighbors who sued them are in the wrong.

-24
jab116•

The HOA approved it lol

33
j_i_x_r•

not according to the suit.

The lawsuit from the Gottliebs says installation of large objects, like a playground, must be approved by the Estrella Subdivisions Architecture and Design Review Committee, and that protocols weren’t followed in this case.

“The Costas failed to submit proper plans and specifications to the ADRC for review prior to installation of the playscape, and the ADRC failed to review and approve Costas playscape in advance as required by ADRC guidelines,” the lawsuit says. It added Estrella “failed to enforce” its own guidelines.

lol

-11
afranke•

KXAN reached out to the Estrella Homeowners Association and it said the Costas did submit the playscape properly for review. As to the final decision on approval, the president did not want to comment because of the pending lawsuit.

https://www.kxan.com/news/local/williamson-county/georgetown-family-faces-lawsuit-over-playscape-for-terminally-ill-son/

HOA said they did it correctly. Just because the lawsuit claims it was incorrect doesn't mean the claim is true.

25
j_i_x_r•

and just because the HOA says they did it correctly doesn't mean the claim is true.

-8
jab116•

There is a reason they dropped the lawsuit, it was approved. Or they are tired of getting their name drug through the mud all over reddit and the news. Either way HOA’s suck for the most part.

;)

16
griffind17•

Knowing how the internet is, I wouldn’t be surprised if they were getting death threats

1
McGurble•

All of which both the family AND the HOA denies. Just because it's in the suit doesn't mean it's true. That what the trial is for.

8
[deleted]•

Don't have a stroke, bruh

17
OfficialNiceGuy•

Based on the grammatical errors I think they already did.

10
ashdrewness•

If my neighbor does something against our HOA, I don’t sue my neighbor, I tell my HOA and let them handle it. It’s literally the purpose of the organization. Sounds like the neighbors who filed suit are out of process. If the HOA made an informal exception for this family then the neighbor has to abide by it (or just choose to run for the board themselves; happens all the time).

Similarly, if my HOA architectural committee approves something I don’t personally like, I don’t get to sue anyone for it because the bylaws effectively state many decisions are at the discretion of the HOA board whom I elected.

17
j_i_x_r•

if the HOA isn't enforcing their rules, then yeah, anyone who is a member of the HOA can directly sue an offending party, i deal with this kinda shit all the time.

-3
gregaustex•

If the kid wasn't sick it would be a non story.

But they were, which is the point.

But more importantly, this "everyone's the asshole" rationale is one of the dumbest most evil things I've seen someone post on reddit for a long time.

the neighbors have every right to have the rules enforced that they all agreed to.

Just because you can, doesn't mean you should. They are fucking evil too.

10
americadotgif•
