What does it mean for my IRA "DRS-ed" shares to be held in custody?

📚 Due Diligence

EDIT: NEW POST HERE WITH MORE PROOF https://www.reddit.com/r/Superstonk/comments/refbzp/your_ira_drsed_shares_held_in_custody_are_being/

I respect your time, so let's get straight to it.

I'm sure many of you have seen u/kitties-plus-titties posting this same comment across different threads. I did, and initially dismissed her claims until her persistence finally got me to try to help. Her intentions were good, but there are many ways to skin a cat.

Statement from Ally

EDIT: NEW INFO FROM PCBSD2's new post

Extracted from PCBSD2's post - markings are mine

This is u/youniversawme's TL;DR

TL;DR

Steps I took to DRS my IRAs:

Step 1: Open and transfer to a matching type IRA at Ally Invest (or Axos, or any other that agrees to be custodian for a DRS transfer)

EDIT: When asked to "enroll in the Securities Income program" or some crap -- read the fine print: it is asking if you want to make money LENDING YOUR SHARES. Check HELL NO ☑️

Step 2: Upload a LOI (Letter Of Instruction) with a bunch of info on it. Cost = $115.

EDIT: Here is a Letter of Instruction template made and shared by u/lucidfer based on my chicken scratched letter. It worked, and feel free to use it as needed!

DRS = Safe Zone. Computershare will protect the beneficial owner (me) from any attempted shady transactions of my shares via mail to me and allow me to override said shady transactions.

If you have issues with the custodians here, Apex or Axos, scroll back up and read that part. I did too, but CS pretty much put them at ease.

Step 3: When it's time to transfer out of DRS, lots of ways to do it, but the easiest (=upload 1 form), fastest (=1-2 days) and cheapest (=free) is to use the DRS Profile system through the broker of your choice, to wherever you want the shares to go.

For me, confirming that Step 3 was a game changer. Not so much to be able to transfer out to sell quickly, but to have the ability to easily transfer out my IRA shares to ANYWHERE I want them to go.

So who's correct? u/kitties-plus-titties? or u/youniversawme?

Let's find out!

One thing to point out in the TL;DR

  1. EDIT: When asked to "enroll in the Securities Income program" or some crap -- read the fine print: it is asking if you want to make money LENDING YOUR SHARES. Check HELL NO ☑️

Why does them asking about this matter?

It means your IRA shares are registered under Ally's name! And with a switch, they can just turn on lending behind your back, just like Fidelity did.

Fidelity vs AER Advisors - https://www.supremecourt.gov/DocketPDF/19/19-347/115806/20190913171623872_AER%20Advisors%20Inc%20et%20al%20v%20Fidelity%20Brokerage%20Services%20LLC%20-%20Petition%20for%20Writ.pdf

But, but...It says DRS invoice #: 00000000000000, so it's DRS-ed and the shares are registered in your name!

Yes, I hear you. Aside from the shady invoice number you're given that I ask you to put on your thinking cap about for a sec, the statement is provided by Ally.

Why does the statement being provided by Ally matter?

Ally was one of those brokers that turned off the buy button back in January. Why do YOU think they can be trusted for what they tell you? What incentive do they have to convince you that the shares are DRS-ed in your name when they actually aren't? Simple. Share lending.

Okay, I don't trust you, this must be a FUD campaign by you shills to discourage us from transferring our IRA shares to ComputerShare!

Sure. You don't have to trust me and I'm not asking that you do.

So who can we trust to find out the truth?

I'm glad you asked. ComputerShare is the authoritative reference that everyone should fall back on with regards to direct registration of shares.

But, but, I eat crayons, I'm too smooth-brained and don't know what to ask them!

No worries, u/The_Kudzu got you covered. Here are some questions he specifically asked to get the answers he's looking for. Corrections are mine in [square brackets] for context. If you have better questions to ask, feel free to add in the comments and I'll edit them in the post.

  1. For clarity, these [IRA shares registered via Apex as custodian] are direct registered shares in my name correct? (see answer in screenshot below)
  2. In the case of a dividend being issued to custodial shares the dividend would be paid out through you to me, correct? (see answer in screenshot below)
  3. As custodian does Apex have any ability to sell these shares, or am I the sole individual that can issue a sell request? (see answer in screenshot below)
  4. EDIT: Are these shares removed from DTCC? Or are they still Beneficially Owned Shares and not Registered-Ownership Shares? (see ComputerShare Company Share Structure image below)
  5. EDIT: Can my custodian lend out my shares with or without my permission?
  6. EDIT: Are my self-directed IRA shares with Camaplan removed from Cede & Co and registered in my name as a registered shareholder in GameStop's ledger?

Possible Proof that your shares are NOT REMOVED from CEDE & CO

/u/The_Kudzu's due diligence with ComputerShare chat https://www.reddit.com/r/Superstonk/comments/rcxt3p/ira_drs_information_regarding_custodial/

Now go forth my fellow IRA apes and do your own due diligence like what u/The_Kudzu and u/kendie2 did here.

And I implore you to share evidence of your correspondence in this thread, link to a ComputerShare chatlog like u/The_Kudzu did, or a recorded voice call with ComputerShare, or even an email reply by ComputerShare.

For those planning to DRS via Camaplan, I suggest you verify the same with ComputerShare as well.

EDIT: Checkbook Control is another way of saying beneficial ownership

This could be a TL;DR of sorts https://www.reddit.com/r/Superstonk/comments/q0mu9l/computershare_cs_now_has_a_diagram_that_shows/?utm_source=share&utm_medium=ios_app&utm_name=iossmf

AFTERNOTE

But..But..ComputerShare doesn't want to entertain my questions!

Transfer ONE share over and ask them! That will give you skin in the game. A 1 share holder is still a shareholder as much as an XXXX share holder.

So I've verified your claims with ComputerShare, wut do? I can't DRS my IRA shares 😭?

u/Cextus has this to say:

I sent an email to gamestop IR, about enabling us to register SDIRA under CS... Let's see what they say.

As for me, my hope is that if enough apes ask about it, GameStop will have their transfer agent enable this service for their shareholders and customers, fingers crossed.

Or just take the tax hit (early distribution) like u/Doom_Douche and a few others did, more info here, the key point: THE 10% PENALTY ONLY APPLIES TO YOUR GAINS AND NOT THE PRINCIPLE OR CONTRIBUTIONS. Or wait till Jan 2022 so the taxman only comes in 2023, giving you plenty of buffer to build up the funds to pay your taxes.

u/Doom_Douche for sharing information on the 10% penalty on gains for IRA shares.

There is a notification button if you’re interested. On mobile apps it’s at the top right. It’s a little bell. If you tap that sucker it’ll keep you updated on a post without you needing to interact with it.

Out of curiosity, do you know how that affects engagement/visibility of the post?

Not a clue.

This is a great collection of all the IRA resources; perhaps even more importantly it’s a solid collection of the unanswered questions.

I am subscribing to this post, and my magic 8 says for visibility and the reasons mentioned above, you should get…

3 awards !

I want to believe… (that DRSing IRA shares IN MY NAME without taking the tax hit or having them with an entity I’ve never dealt with is really an option…)

7
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

Thanks for the awards and acknowledgement, if you have IRA with CS, it would be very helpful to ask CS and share evidence of your correspondence with the rest of the apes for them to make their own informed decisions

3
russwanson•

I have not (yet!) rolled (or whatever the correct word is) an IRA to CS - although I’ve saved (and shared) u/youniversawme ‘s posts, I still haven’t gotten my brain around this:
https://www.irs.gov/retirement-plans/plan-participant-employee/rollovers-of-retirement-plan-and-ira-distributions - and namely the “IRA one-rollover-per-year rule”.

Edit: though apparently there may be applicable exceptions:
“The one-per year limit does not apply to:

rollovers from traditional IRAs to Roth IRAs (conversions) trustee-to-trustee transfers to another IRA IRA-to-plan rollovers plan-to-IRA rollovers plan-to-plan rollovers”

But financial advice and tax advice are way beyond me, so keep doing your own research…

Well, when you get around to asking ComputerShare, pls do share your findings! Especially their answer on whether shares held in custodian are directly registered in your name and removed from the DTCC.

Because if it's not removed from the DTCC, then you are not actually DRS-ing your IRA shares since they can still lend your shares out, like how fidelity did with AER advisors

u/jsmar18 would be great if there's a channel for us to have ComputerShare answer these questions in their FAQ and put the debate to rest

It died in new, i'm planning to repost this come Mon just before market close, apparently it's the period of time when most are online according to 1fuzzypickle (online activity tracking guy)

I think an IRA Distribution In-Kind is the way. I did it back in early September after months of pushing the issue. I will try and keep it alive on Monday, or at least do my part .

3
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

thank you, that will be immensely helpful for the other apes to make their own informed decisions!

2

Most definitely. Thank you. I wanted to write something up to spread the word and came across your post. I think it'll help apes see a bigger picture.

2
Irod0824💻 ComputerShared 🦍•

Thank you for putting this together. Been trying to spread this message for a while.

I've personally done 2 transfer in kinds (see post history) to ensure I have full ownership and control. I'll take tax hits now compared to later!

DRS is the way! 🚀 🚀 🚀

4
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

Yea, really need help getting the word out to apes for them to do their due diligence and post evidence of their correspondence. That will help build consensus essential for the community to make more informed decisions regarding their IRA shares

beltedfiber🦍 Buckle Up 🚀•

So what is the difference between a typical Roth GME share and a custodian Roth GME share? In my mind it still locks up the float because the shares will show in my CS account.

I'm getting frustrated with conflicting info and I suppose that is the purpose of making us question ourselves and slowing down DRS. Trying to get my shares in the safest possible situation, but can't constantly be concerned with endless what ifs. I'm tired of jumping through these hoops, I shouldn't have to be doing any of this bullshit if the system worked properly.

4
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

I empathize with your frustration that the bullshit the system is is making us jump through all these hoops.

Doom_Douche and a few other apes have opted for early distribution and taking the tax hit to ensure their shares are truly registered in their name in GME's company ledger and unlendable

Regrettably, I'm not the best person to provide you answers with regarding the difference between the two but I'm sure ComputerShare will be able to better provide the answers you seek.

You can ask ComputerShare the 6 questions I have listed above and see what they tell you

its_an_f5💻 ComputerShared 🦍•

u/youniversawme asked a lot of the important questions in their DD and even moved some shares around to find out what would/could happen.

Personally I don't give a fuck who's name is on the account if 1) I control it and 2) the are removed from the DTCC. The original DD still holds up in both cases.

3
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

Spoiler alert: they're not removed from the DTCC

Spoiler spoiler alert: don't trust me, don't trust this commenter, check with ComputerShare, the authoritative reference, and share your correspondence with the rest

6
its_an_f5💻 ComputerShared 🦍•

u/youniversawme did this. There's a screenshot showing DTCC withdrawal.

It would still be better for GameStop to offer an IRA directly.

4
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

Is that screenshot provided by Ally? Or provided by ComputerShare?

I won't put it past them to lie to you that the shares are direct registered in your name since it's a clear conflict of interest (they can lend them out if it's not actually in your name). Always verify with the authoritative reference, ComputerShare in this case.

4
its_an_f5💻 ComputerShared 🦍•

It's a computershare screenshot.

4
youniversawme🦍 Buckle Up 🚀•

Funny Computershare told me they are in DRS.

2
AzureFenrirOPinfinity, ape believe 🦍🚀🌌🌠✨•

Funny why Ally would ask you to lend your shares if they're actually registered in your name

EDIT:

As long as your IRA shares are not removed from the DTCC, then you are not actually DRS-ing your IRA shares since they can still lend your shares out, like how fidelity did with AER advisors

Which is the whole point of DRS tbh, remove the float to actually lock it so they can't short sell

3
youniversawme🦍 Buckle Up 🚀•

Haha, yeah that is standard for opening an account, and quite sneaky the way they ask it— I agree they are no better than any other broker— that’s how they make their money, but it has nothing to do with registered shares. I don’t care what they do once the shares are in DRS at Computershare because the fact is they are no longer in my account at Ally.

2

You don’t control the shares if they lend them out behind your back
