Homeowner directive on our walk this morning

People usually have nice things to say about my huskies. This morning, I took an unusual route. We came upon on house with an usually immaculate lawn. There were no leaves on the lawn, but the sidewalk was ankle-deep with leaves. We were walking on the sidewalk. The homeowner said, "Don't let them piss on my lawn. It'll burn it." And I said, "OK, I won't, sir. Did you see them do that?" "I said don't let them."

This is weird, right? Does a homeowner have a legal recourse against the dog owner if a dog urinates on the easement?

I am so glad I live in a rural area.

If someone takes the time to care for their lawn, it's a pretty bad move to let your dogs pee on their lawn. (Not saying you did, I just mean in general). Lawn care is expensive. Also if the yard is that nice there's a good chance that there are chemicals on their lawn that you wouldn't want your dog sniffing around.

Weird for the guy to call you out, but to an extent I get it.

To what easement are you referring?

The public easement for traveling on the street.

The easement allows you to walk on the sidewalk. Once your dog or you steps on his lawn, you are no longer on the easement (at least that's how I understand it). Hence trespassing laws.

From your post, it appears you were on the sidewalk, so no issues there. The homeowner was simply issuing a warning to not let your dog urinate on his lawn. Seems reasonable. His lawn, his rules and all that.

I think the term is "right of way".

In my area, the public right of way extends from the center line of the street to 25 ft on each side. Use of and development in the public right of way is subject to local ordinances.

So our sidewalks go right up to the edge of the right of way, so any grass on the street side legally... I think you can tell them to go kick rocks. I think I agree with the "your lawn your rules" statement about the other side.

We generally respect signage if people don't want plants peed on or whatever, but you can bet your ass that if you regularly block the sidewalk or fail to shovel in the winter.... We won't be bothered to be careful about picking up all of our dogs' shit.

it might be "his lawn, his rules" but he also doesn't have to be a rude a-hole about it.
